Overview

The Kahnawake Gaming Commission (KGC) is the gambling regulator for Kahnawake, a Mohawk territory south of Montreal in Quebec, Canada. It was established under the Kahnawake Gaming Law, enacted by the Mohawk Council of Kahnawake in 1996.

The commission claims its own jurisdiction based on Indigenous rights recognized by the Canadian Constitution (1982). With the “Regulations Concerning Interactive Gaming” introduced in July 1999, it became one of the world’s earliest online gambling regulators, even earlier than Malta and the UK.

Licensing and data center

Kahnawake grants online operators a permit called a Client Provider Authorization (CPA). The initial application cost is $40,000. Approved operators run their servers in a data center inside Kahnawake (Mohawk Internet Technologies). This is because the servers must be within the territory for the commission to exercise jurisdiction.

So far, more than 50 online operators and about 250 sites have received Kahnawake licenses. Besides online, it also oversees three offline poker rooms within the territory.

The Ultimate Bet case

The biggest incident to test Kahnawake’s reputation was the insider cheating at the online poker site Ultimate Bet in 2008-2009. It emerged that people connected to the company had unfairly won money using the ability to see other players’ cards. After its investigation, the commission ordered the operator to return about $22 million to victims, pay a $1.5 million fine, and improve its operations. The case drew criticism that regulation was lax, but also a view that the commission had at least a minimum of enforcement power.

Withdrawal from the US market

In September 2016, the commission reached an agreement with the New Jersey Division of Gaming Enforcement to stop issuing licenses to operators that accept US players. As US states opened their own online markets one by one, it cooperated in cracking down on unlicensed offshore sites.

After Ontario opened

When Ontario opened its private online market in 2022, the status of companies serving Canadian players under Kahnawake licenses became controversial. Kahnawake asserts jurisdiction based on Indigenous self-governance, while Ontario demands that operators enter its provincially regulated market, and the standoff continues.

Rating

Kahnawake is classed alongside Curaçao as a relatively easy-to-obtain offshore license. However, as Curaçao tightened its system in 2024 and looser options such as Anjouan have appeared, the trust ranking among offshore licenses is also shifting. For players, it is safer to also check for licenses like Malta MGA or UKGC.

Location

Kahnawake is a Mohawk territory located across the St. Lawrence River from Montreal, Canada.
